The Civil Law (Sale of Residential Property) Act 2003 (the Act) stipulates the following documentation must be completed before an ACT property can be advertised or marketed for sale in the ACT.
A Contract for Sale – including Title Search and Crown Lease (a standard contract a solicitor can prepare for you)
An Energy Efficiency Rating Report (not applicable for sale of vacant land)
A Building Inspection*
A Pest Inspection*
Note: *Applicable to Houses/Townhouses/Villas – not applicable to: land only sales; properties in multi-storey structures (Units/Apartments); or off-the-plan properties/newly-built-properties.
There is a specific field in the listing form where you must include the Energy Efficiency Rating (EER). Failure to comply with this may result in prosecution by the Office of Regulatory Services.
The Act states 'A seller of residential property commits an offence if the required documents are not all available for inspection by a prospective buyer at all times when an offer to buy the property may be made to the seller'.
