Fresh fallout follows feud

Top-end agency RT Edgar Toorak and one of its directors, Greg Herman, have parted company as the fallout continues from a bitter legal feud about the sale of a Toorak property to a plastic surgeon.

The split follows a recent County Court ruling that found Mr Herman had concocted a phoney offer to inflate the purchase price of two apartments bought after auction by Dr Chris Moss, whose company, Peachbulk, was subsequently awarded $200,000.

RT Edgar Toorak and Mr Herman are also facing a disciplinary inquiry into their conduct by Consumer Affairs Victoria, which will determine if they are “fit and proper” to hold an estate agent’s licence.

The break comes despite RT Edgar appearing to back Mr Herman in a media statement released after the County Court ruling.

“Our belief is that we conducted ourselves professionally and with the highest integrity at all times and our track record shows no previous allegations of this nature bought against us,” the statement said.

“However, a judgment has been made and our decision is to focus on ensuring our business does not come under question again.”

Costs that could exceed $1 million are yet to be awarded in the landmark legal saga, with the County Court expected to rule before Christmas on an application by Dr Moss for compensation for the plastic surgery-related income he lost while in court.

RT Edgar Toorak and Mr Herman declined to comment when contacted by Private Property.
